Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the TennisCY mobile application ("App") or this website (collectively, the "Service"), you ("User", "you") agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately cease using the Service.

These Terms constitute the entire and exclusive agreement between you and TennisCY ("we", "us", "our") regarding your use of the Service and supersede all prior agreements, representations, and understandings, whether written or oral.

These Terms apply to all users, including during any TestFlight beta period, upon public App Store release, and at all times thereafter.

2. Eligibility

You must be at least 16 years of age to use TennisCY, in accordance with the age of digital consent under the laws of the Republic of Cyprus and EU Regulation 2016/679 (GDPR). By creating an account, you represent and warrant that you are 16 or older.

If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. TennisCY reserves the right to request proof of age or parental consent at any time and to suspend accounts where eligibility cannot be confirmed.

You further represent that you are not barred from receiving services under the laws of Cyprus or any other applicable jurisdiction, and that you have not been previously suspended or removed from the Service.

3. Description of Service

TennisCY is a digital platform that enables registered users in Cyprus to:

• Create a public player profile displaying skill level and general location.
• Browse other registered users and express interest in arranging tennis matches.
• View a community-sourced map of tennis courts across Cyprus.
• Log self-reported match results and view a community ranking leaderboard.

TennisCY is solely a communications and information platform. We are not a tennis club, sports organisation, coaching provider, event organiser, facility operator, or sporting association. We do not organise, supervise, or participate in any matches or physical activities. All matches, arrangements, and interactions are initiated, organised, and carried out exclusively between users, entirely at their own risk and discretion.

4. Physical Activity — Assumption of Risk

Tennis and all physical sport activities carry inherent risks of personal injury, including serious injury or death. By using TennisCY to arrange or participate in any tennis match or other physical activity, you expressly acknowledge and voluntarily assume all risks associated with such activities, including but not limited to:

• Musculoskeletal injuries, sprains, fractures, and strains.
• Cardiovascular events, including heart attack and stroke.
• Head injuries, concussions, and eye injuries.
• Injuries caused by the conduct, negligence, or actions of other users.
• Injuries arising from court surfaces, equipment, or environmental conditions.
• Any other injury or harm arising directly or indirectly from physical activity.

You represent that you are in good physical health and that no medical condition prevents you from safely engaging in tennis or physical sport. You are strongly advised to consult a qualified medical professional before engaging in any physical activity arranged through the Service. TennisCY accepts no responsibility for any injury, illness, death, or physical harm arising from any activity arranged through or in connection with the Service.

5. No Identity Verification or Background Checks

TennisCY does not verify the identity, background, credentials, character, or intentions of any user. We do not conduct criminal background checks, identity checks, or any form of vetting on users who register on the platform. Profile information is entirely self-reported and unverified.

You acknowledge and accept that when arranging to meet another user, you are meeting an individual who is substantially unknown to us and who we have not screened in any way. You are solely responsible for exercising appropriate caution and judgment when interacting with or meeting other users. TennisCY expressly disclaims all liability arising from your interactions with other users, whether or not those interactions were facilitated through the Service.

6. User Accounts and Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised access to your account. TennisCY shall not be liable for any loss or damage arising from your failure to maintain account security.

You agree to provide accurate, current, and complete information when registering and to keep your profile information up to date. You may not create more than one account, transfer your account, or allow any other person to use your account.

7. Acceptable Use

You agree to use the Service lawfully, respectfully, and in accordance with these Terms. You must not:

• Harass, threaten, intimidate, stalk, or abuse any user.
• Post or transmit false, misleading, defamatory, obscene, or offensive content.
• Impersonate any person or misrepresent your identity, skill level, or affiliation.
• Solicit money, personal financial information, or anything of value from other users.
• Use the Service for any commercial solicitation or advertising without our written consent.
• Transmit spam, chain letters, or unsolicited communications.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, scrape, or create derivative works from the Service.
• Use automated tools, bots, or scripts to access or interact with the Service.
• Upload or transmit any virus, malware, or other harmful code.
• Use the Service to facilitate or commit any unlawful act under Cyprus or EU law.

We reserve the right to suspend or permanently terminate any account for any breach of these rules, or for any conduct we determine in our sole discretion to be harmful to users or the Service, without notice and without liability.

8. User-Generated Content

By submitting any content to the Service (including but not limited to profile photos, display names, match results, and any other material), you grant TennisCY a worldwide, non-exclusive, royalty-free, sublicensable, perpetual licence to use, store, display, reproduce, and distribute that content solely for the purposes of operating and improving the Service. You retain ownership of your content.

You represent and warrant that you own or have the necessary rights to the content you submit, that the content does not infringe any third-party rights, and that the content is not unlawful, defamatory, or offensive. TennisCY reserves the right, but is not obligated, to review, edit, or remove any user content at any time and for any reason, without notice or liability.

9. Court Information Disclaimer

Court listings displayed within the Service are sourced from community contributions and publicly available information. TennisCY makes no representation, warranty, or guarantee of any kind regarding the accuracy, completeness, currency, or reliability of any court information, including but not limited to opening hours, availability, pricing, surface type, facilities, access conditions, or operational status.

You must independently verify all court information directly with the relevant facility before travelling or making any arrangements. TennisCY accepts no liability for any loss, inconvenience, cost, or harm arising from reliance on court information displayed in the Service.

10. Rankings Disclaimer

The ranking system within TennisCY is based entirely on self-reported match results submitted by users. TennisCY does not verify, supervise, or validate any match results. Rankings are provided for community entertainment purposes only and have no official status. TennisCY accepts no liability for any decisions made in reliance on ranking data.

11. Third-Party Services

The Service relies on third-party platforms and services, including but not limited to Apple Inc. (App Store and TestFlight distribution, push notifications), Supabase (database infrastructure), and GitHub (website hosting). These services are governed by their own independent terms of service and privacy policies. TennisCY is not responsible for the availability, performance, or conduct of any third-party service.

The Service may contain links to external websites. TennisCY does not endorse, control, or accept responsibility for any external content and shall not be liable for any loss or damage arising from your use of external sites.

12. Apple App Store — Additional Terms

If you download the App through the Apple App Store, the following additional terms apply:

• These Terms are between you and TennisCY only, not with Apple Inc.
• Apple has no obligation to provide any maintenance or support for the App.
• Apple is not responsible for any product liability claims relating to the App.
• Apple is not responsible for investigating or addressing any third-party intellectual property infringement claims relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You must comply with applicable App Store terms of service when using the App.

13. Service Availability and Beta Use

The Service is provided on an "as-is" and "as-available" basis. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without any liability to you.

During the TestFlight beta period, the Service is provided for testing purposes only. Features may be incomplete, unstable, or subject to change or removal at any time without notice. You acknowledge that beta software may contain errors and that use during the beta period is at your own risk.

14. Intellectual Property

All intellectual property rights in and to the Service, including but not limited to software, code, design, branding, graphics, text, and the TennisCY name and logo, are owned by or licensed to TennisCY. Nothing in these Terms grants you any right, title, or interest in our intellectual property. You may not copy, reproduce, modify, distribute, or exploit any part of the Service without our prior written consent.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, TennisCY expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title. We make no warranty that:

• The Service will meet your requirements or expectations.
• The Service will be available, uninterrupted, timely, or error-free.
• Any information obtained through the Service will be accurate or reliable.
• Any defects or errors will be corrected.
• The Service is free of viruses or other harmful components.

16. Limitation of Liability

To the fullest extent permitted by applicable law, TennisCY, its owners, directors, employees, agents, and affiliates shall not be liable for any:

• Personal injury, death, or bodily harm of any kind.
• Indirect, incidental, special, consequential, exemplary, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from your reliance on any information provided through the Service.
• Damages arising from the conduct or actions of any third party, including other users.
• Damages arising from unauthorised access to or alteration of your data.
• Damages arising from any interruption or cessation of the Service.

In any event, our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the total fees paid by you to TennisCY in the twelve months preceding the claim, or (b) €50 (fifty euros). During any free or beta period, our total liability shall not exceed €0.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

17. Indemnification

You agree to defend, indemnify, and hold harmless TennisCY and its owners, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the Service.
• Your breach of any provision of these Terms.
• Your violation of any applicable law or regulation.
• Your user-generated content.
• Any physical activity, interaction, or dispute involving you and another user.
• Any claim by a third party arising from your conduct on or through the Service.

18. Force Majeure

TennisCY shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, strikes, power outages, internet failures, or failures of third-party service providers.

19. Account Termination

You may delete your account at any time from within the App or by emailing [email protected]. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

We reserve the right to suspend or permanently terminate your account and access to the Service at any time, at our sole discretion, with or without notice, and without liability to you, for any reason including breach of these Terms, conduct harmful to other users or the platform, or prolonged inactivity.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service immediately.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, such provision shall be deemed severed from these Terms and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

22. Waiver

No failure or delay by TennisCY to exercise any right or remedy under these Terms shall operate as a waiver of that right or remedy. A waiver of any breach of these Terms shall not constitute a waiver of any subsequent breach.

23. Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. TennisCY may assign or transfer its rights and obligations under these Terms at any time without restriction and without notice to you.

24. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions.

You irrevocably submit to the exclusive jurisdiction of the courts of the Republic of Cyprus to settle any dispute or claim arising out of or in connection with these Terms or the Service.
